In the state of Alaska you must be twenty-one to consume alcohol and nineteen to consume tobacco.
The
city of Anchorage Alaska passed a law making drug paraphernalia illegal.
That in-its-self is a good thing. But hear how police used this
law to prove Hookahs, Water Pipes and Glass Hand Pipes are only manufactured
for narcotics. Hear how police used this law to raid a store and seize
thousands of dollars of merchandise and then convict the owner of selling drug
paraphernalia.
On March 12, 2001, a Mrs. Egan, (a lady that lives in the neighborhood), came into a store and didn’t like what she saw for sale. So she went home and called the police. The police raided and seized merchandise from the store. The store sells pipes for smoking herbs and tobacco, and black light posters from the 60's, silver jewelry, scales to weigh everything from babies to gold, toys, blow-up sheep and dildos. The store also sells a lot of nicotine alternatives, herbs.
What you will hear are the actual proceedings, testimony by police officers testifying that the only place they have ever seen glass pipes is in a narcotics raid, proving that glass pipes are only manufactured for narcotics.
The recording is not great some of the time because people were not talking into the microphone. So when the volume gets a little low you might want to turn it up a bit.
Are Herb and Tobacco pipes only for Narcotics because they hold water, have a
hose or a small bowl, or are made out of glass?

Hear the prosecutor explain to the jury that because a magazine, High Times, is near pipes that proves the pipes are manufactured for narcotics. See the actual picture, (Plaintiff's exhibit 27), shown to the jurors. Prosecution never said a word about the Alaska Voter Registration book in front of it.
Hear an undercover narcotics officer declare a hookah to now be a Bong allowing three people to smoke marijuana out of it.
Hear the Detective go thru boxes of seized merchandise and explain why every item seized is intended only for the consumption of narcotics. Police even seized candles, incense burners and trinket boxes. You can listen to a policeman discover them in a box and then explain that incense is used primarily to cover-up the smell of Marijuana. Hear him declare that trinket boxes are probably used to stash Marijuana. You really don’t believe this, do you?
Hear the judge declare the "Dug Out Quit Smoking System" drug paraphernalia because it was in the area and an officer said it's used for drugs. Even a kitchen food scale, (one of a selection of scales), is used for narcotics because it was for sale in the same store.
A police officer is never given training to identify herbs because they are not illegal. Therefore when he raids a place for narcotics and sees pipes, that proves the pipes for sale in the downtown store can only be manufactured for narcotics.
You learned about our legal system in school . Does this case prove our system works? Was the "burden of proof" on the prosecution to prove the seized items are intended for drugs or was the "burden of proof" placed on the defendant to prove that the pipes weren't intended for drugs? Do you still beat your wife?

The shop owner was convicted of selling drug paraphernalia largely in part by testimony of police officers explaining that pipes with a small bowl are for narcotics. The court agreed and ruled such during discovery.
When the Judge was asked to give a definition of a "small bowl" after proceedings, what do you think he said? Remember, the shop owner lost thousands in merchandise, has to spend twenty days in jail and pay a fine of $2,500.00 plus court fees for selling pipes with small bowls. Funny the shop owner should want to know the legal size of a tobacco pipe bowl, don't you agree?
